These Terms and Conditions ("Terms") govern your access to and use of Mimesis, available at mimesis.myatelier.in (the "Service"), operated under the "Atelier Labs" brand ("we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.
You must be at least 18 years old to create an account or use Mimesis. By using the Service, you represent that you meet this requirement. This age floor exists because the Service processes real photographs of faces to generate personal models, try-on images, and custom content.
Mimesis lets you:
Image generation is powered by third-party AI models (currently Nano Banana, Nano Banana Pro, and Klein 4b, accessed via Replicate and other model providers). Output quality, style, and accuracy of likeness are not guaranteed — AI-generated images can be imperfect or unpredictable.
Ownership: You retain ownership of the photos you upload and the images Mimesis generates for you, subject to the underlying rights of any third-party model provider and any pre-existing rights in preset assets we provide.
License to us: By uploading a photo or generating an image, you grant us a limited license to process, store, and transmit that content solely to provide the Service to you. We do not use your photos or generated images to train our own AI models.
Your responsibility: You represent that you own or have the necessary rights and consents to upload any photo you submit, and that:
Mimesis offers subscription tiers — Starter, Creator, and Studio — billed monthly or annually.
The Service uses a credit-based system. Credits granted for a billing cycle (whether through a paid plan or a free onboarding allowance) expire at the end of that billing cycle and do not roll over to the next cycle. Unused credits are forfeited when a new cycle begins or when a subscription is cancelled or downgraded.
Credits have no cash value, are non-transferable, and cannot be exchanged for cash.
Refunds may be requested within 7 days of a paid purchase, provided the account has not used any part of the Service during that billing period — including creating or uploading a character/model, generating images, upscaling, or using Try-On. Onboarding actions such as character creation consume compute resources on our end regardless of whether they are billed in credits, so once a character has been created, the account is considered to have used the Service and the purchase is non-refundable. This eligibility resets with each new billing period; a returning subscriber may request a refund on a later renewal if that renewal itself has not been used, even if a prior period was used. Outside of this window and condition, all payments are non-refundable except where required by applicable law.
You agree not to use Mimesis to:
We may suspend or terminate your access to the Service if we reasonably believe you've violated these Terms, misused the Service, or engaged in fraud. You may delete your account at any time via account settings.
The Service's branding, software, and interface are owned by us or our licensors. The underlying AI models (Nano Banana, Nano Banana Pro, Klein 4b) are the property of their respective owners and are made available via Replicate and other model providers.
The Service relies on Google, Supabase, Backblaze B2, Cloudflare, Replicate, and Paddle. We are not responsible for outages or errors by these providers beyond what's disclosed in our Privacy Policy.
The Service is provided "as is" and "as available," without warranties of any kind.
We do not warrant that the Service will be uninterrupted, error-free, or that generated images will meet your expectations of quality or likeness.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or punitive damages. Our total liability will not exceed the amount you paid us in the [3/6/12] months preceding the claim.
You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms, violation of law, or content you upload or generate (including failure to obtain consent for likenesses).
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in Goa, India.
We may update these Terms from time to time. Material changes will be notified via email or in-product notice.
